We own a creekside farm in rural Giles County VA (Appalachia). A companys 7500-gallon red-diesel spill into our creek affected our historic property on 2/14/08. We are now thousands of dollars in debt to environmental professionals we needed to help us (attorney and env. consultant to professionally document spill and clean-up) and have not yet been able to seek compensation from the polluter--we are still gathering facts. The polluter is legally aggressive toward us threatening us with a defamation suit for making a private complaint as citizens to the federal government; the polluter had failed to notify EPA of the spill to the waterway. The polluter also has failed for 10 months to perform mandated drinking-water tests here or complete remediation and site restoration. This is an uphill battle. We need help--a loan or grant to hold us over and pay professional fees until we can get compensated. We dont want to lose the picturesque farm thats been in our family since 1791 which is about to be placed on the National Register of Historic Places just because we cant afford all of these fees right now.
